BIKINGPERUTREK PRIVACY AND PERSONAL DATA PROCESSING POLICY

This privacy and personal data treatment policy (hereinafter, the “Policy”) will be applicable to the holders of personal data who contract the individualized transportation service by means of bicycles (hereinafter, the “Service”) and who give their consent to this Policy and will remain in force until they revoke their authorization to the treatment of their personal data. In accordance with the provisions of Law No. 29733 – “Personal Data Protection Law”, its Regulations, approved by Supreme Decree No. 003-2013-JUS and other complementary provisions, the owner of this database in which personal data will be stored is BikingPeruTrek E. I.R.L, with Single Taxpayer Registry N° 20603241721, domiciled for these purposes in SECTOR RUMICHACA BAJA S/N URUBAMBA – CUSCO PERU (hereinafter “BikingPeruTrek”). BikingPeruTrek obtains from the owner of the personal data (hereinafter, the “Owner”), this declaration of consent for the processing of personal data.

As a normal part of our general activities, we collect and, in some cases, disclose information about users of the service (hereinafter, the “Users”). This Policy describes what personal data BikingPeruTrek collects from the Registrant and what may be done with that information. This Policy is very detailed because it is important that all Data Subjects who access the Service are made aware of BikingPeruTrek’s practices as accurately as possible.

The Holder expressly accepts and gives its free, express, prior, informed and unequivocal consent for BikingPeruTrek, who owns the database, use and perform the processing of personal and identifiable information of the Holder under this Policy.

With the consent of the Data Subject, BikingPeruTrek may collect the information provided by the Data Subject (detailed in paragraph 1.1 of this Policy). In the same way, the Data Subject authorizes BikingPeruTrek to collect, access, record, organize, store, preserve, process, modify, extract, consult, use, block, deliver for processing on behalf of the Data Subject, transfer nationally and internationally, communicate, modify, delete and, in general, process his or her personal data.

The privacy of the personal data of the Holder is very important for BikingPeruTrek. It is for this reason that precautions and precautions are taken to protect your information, using the most complete and effective computer security mechanisms for the protection of information.

FIRST: PERSONAL DATA COLLECTED

 1.1. In order to access the BikingPeruTrek Service, Data Subjects must register, providing certain complete and accurate personal data. BikingPeruTrek may request, collect and store the following personal data: nickname or pseudonym (name of Data Subject) to operate on the BikingPeruTrek site, first and last name, document number or valid ID, physical contact information (such as phone number, address, e-mail address, etc.).

SECOND: USE OF PERSONAL DATA

2.1. In order to efficiently provide the service and so that the Holder can apply in an agile and easy way to the services, BikingPeruTrek requires certain personal information. The collection of information allows us to offer the Holder the services and features that best suit their needs. The personal data collected has the following purposes:

  • To provide an efficient and fast service.
  • Customer Service contact with the Holder in case of any eventuality arising during the provision of the Service.
  • Develop internal studies on the interests, behaviors and demographics of the Data Subject to better understand their needs and interests and offer better services or provide them with related information.

Your personal data will only be used for limited purposes, such as those set forth herein.

THIRD: CONFIDENTIALITY OF PERSONAL DATA

3.1. Once registered with the Service, BikingPeruTrek will not sell, trade, rent or share the personal data of the Data Subject except as set out in this Policy. BikingPeruTrek will make every effort to protect the privacy of personal data. Notwithstanding the foregoing, it may happen that, pursuant to court orders, where permitted by law, or in case of prevention of money laundering or terrorist financing, BikingPeruTrek may disclose personal data to authorities or third parties without the consent of the Data Subject.

FOURTH: PERSONAL PASSWORD

4.1. In order to access the services reserved only for the duly registered Beneficiary, the Beneficiary shall have a personal password. With it you can hire and qualify the services provided by third parties through the virtual application of the Service (available in the stores “Google Play” and “App Store” under the name “BikingPeruTrek” (hereinafter the “Application”). The Holder shall keep this password under absolute confidentiality and, under no circumstances, shall disclose it or share it with other people.

4.2. The Holder shall be responsible for all the acts that take place through the use of its name of Data Holder and password, which includes being responsible for the payment of the fees that may eventually be accrued or for the damages that other Data Holders may suffer for such reason. If for any reason a Data Holder believes that someone may know his/her password, he/she must modify it by entering the modification option provided for that purpose in the BikingPeruTrek platform.

FIFTH: MINORS

5.1. The Service is aimed exclusively at people over 18 years, being therefore restricted the entry of children under 18 years to the same. Notwithstanding the foregoing, BikingPeruTrek reserves the right to verify, by any means it deems appropriate, the actual age of any Data Subject.

 5.2. Upon suspicion that a Data Subject of the Service is under 18 years of age, and has falsified the data required for access, BikingPeruTrek may deny the Data Subject access to the services offered.

SIXTH: LEGAL REQUIREMENTS

6.1. BikingPeruTrek will cooperate with the competent authorities and other third parties to ensure compliance with laws. BikingPeruTrek may disclose the personal data of the Holder without their consent only when permitted by law, required by court order, or in cases of prevention of money laundering or terrorist financing or the case that such Holder is involved in illegal activities. In such situations, BikingPeruTrek will cooperate with the competent authorities in order to safeguard the integrity and security of the community and that of its Data Subjects.

SEVENTH: SECURITY AND STORAGE OF PERSONAL DATA

7.1. BikingPeruTrek is required to comply with all applicable regulations on security measures applicable to personal data. In addition, BikingPeruTrek use industry standards in protecting the confidentiality of personal data, including, among other measures, firewalls (“firewalls”) and Secure Socket Layers (“SSL”). BikingPeruTrek considers the Holder’s personal data as an asset that must be protected from any loss or unauthorized access. To this end, BikingPeruTrek employs various security techniques to protect such data from unauthorized access by Data Subjects inside or outside the company. Notwithstanding the foregoing, considering that the Internet is an open, publicly accessible system, BikingPeruTrek cannot guarantee that unauthorized third parties will not eventually be able to overcome security measures and misuse personal data.

7.2. The Holder knows and expressly agrees that BikingPeruTrek , at its sole discretion, collect, store and eventually monitor the exchange of messages and emails between the Holder and Customer Service, made by any means available, with the sole purpose of contributing to the security of relations and communications that take place in the Service.

BikingPeruTrek is not responsible for illegal interceptions or violation of their systems or databases by unauthorized persons. BikingPeruTrek , is not responsible for the misuse of information obtained by such means.

7.4. The personal data of the Data Subject will be stored in the database of BikingPeruTrek, the same that is in a file or automated support of personal data located at: calle garcilaso 284 Cusco – Peru in that sense, BikingPeruTrek has complied with declaring the cross-border flow of personal data, as well as its purpose and the information of the receiving entity (ies). Based on the foregoing, by accepting this Policy, the Data Subject consents to BikingPeruTrek to transfer his or her personal data internationally.

7.5. BikingPeruTrek E will share personal data (including e-mail address) with service providers or “banahosting” companies or companies with whom BikingPeruTrek has a collaborative relationship or alliance, which contribute to improve or facilitate operations through BikingPeruTrek . The companies previously described with which personal data will be shared are the following: a company Alpharest.pe, with RUC 10762608338 and legal domicile in Jr. Paruro D13 Urb. Progreso, District of Wanchaq, Province of Cusco, Department of Cusco-Peru.

BikingPeruTrek will ensure that certain standards are met by signing agreements or agreements whose purpose is the privacy of personal data of the Data Subject. In some cases, these service providers will be those who collect information directly from the Holder (for example, if we ask them to conduct surveys or studies). In such cases, you may receive a notice about a service provider’s participation in such activities, and it will be at the Data Subject’s discretion as to what information they want to provide to you and what additional uses the service providers decide to make. In the event that the Holder provides additional information on its own initiative to such service providers directly, such providers will use this information in accordance with their own privacy policies. BikingPeruTrek is not responsible for the improper use of the Holder’s personal data by companies or Internet sites acting on their own behalf.

EIGHTH: CHANGE OF E-MAIL PREFERENCES

8.1. Notwithstanding that BikingPeruTrek wants to keep the Registrant updated at all times about promotions, news, changes, etc., the Registrant can select the e-mails and promotional information that he/she would like to receive from BikingPeruTrek, provided that the Registrant has consented to receive this information.

8.2. In the event that the Data Subject does not wish to receive such e-mails, the Data Subject may unsubscribe by changing his/her e-mail preferences by following the instructions that BikingPeruTrek provides in its communications.

NINTH: RIGHTS OF INFORMATION, ACCESS, CANCELLATION, RECTIFICATION AND OPPOSITION OF PERSONAL DATA

9.1. The Data Subject exercises the rights of access to their data held by BikingPeruTrek, know the characteristics of their treatment, rectify them if they are inaccurate or incomplete, request their deletion or cancellation, as well as to oppose their treatment and to be informed of the assignments and / or international transfers of personal data carried out, all in accordance with the provisions of the applicable regulations.

 The user may at any time revoke the consent expressly granted, as well as limit the use or disclosure of their personal data.

In order to exercise the aforementioned rights, the Holder must submit a request through the email [email protected]. The respective request in the terms established by the regulations of Law No. 29733, including the following information: name of the holder and address or other means to receive a response; documents proving their identity or legal presentation, clear and precise description of the data in respect of which it seeks to exercise its rights and other elements or documents that facilitate the location of the data.

BikingPeruTrek will communicate to third parties to whom it has transferred the data of the Holder, however, will not be liable for the acts of third parties. In addition, BikingPeruTrek will act within the time limits of the law.

9.2. The Holder guarantees and responds, in any case, the truthfulness, accuracy, validity and authenticity of the personal data provided, and undertake to keep them properly updated.

9.3. Once registered with BikingPeruTrek , the Data Subject may review and change the information that he/she has submitted to BikingPeruTrek during the registration process, including:

The email address. Notwithstanding any changes you make, BikingPeruTrek will retain the above personal data for security and fraud control purposes.

Registration information such as: address, city, region, zip code, main phone number, email address, etc.

The PIN code.

9.4. BikingPeruTrek will retain the personal data of the Holder for a period of one (1) year in order to resolve disputes or claims, detect problems or incidents and solve them, and comply with the provisions of the Terms and Conditions. BikingPeruTrek may modify this Policy and / or practices of sending e-mails. In the event that BikingPeruTrek modifies the Policy, BikingPeruTrek will notify the Registrant by posting an updated version of the Policy in this section or by sending an e-mail or by informing the Registrant on the homepage or other

sections of the Application to keep the Registrant updated of the changes made. The Holder must decide whether or not to accept the changes to the Policy. In the event that the Data Subject does not accept the new terms and conditions of the Policy, the link between the Data Subject and BikingPeruTrek will be dissolved and the personal data of such Data Subject will not be used in any other way than the one that was informed at the time of collection.

9.5. If the Data Subject considers that he/she has not been attended in the exercise of his/her rights, he/she may file a complaint with the Directorate for the Protection of Personal Data, by contacting the Ministry of Justice and Human Rights: Address: Av. Micaela Bastidas 657-B, Cusco – Peru.

9.6. BikingPeruTrek will be responsible for the personal data bank and the personal data contained therein. In order to prevent the loss, misuse, alteration, unauthorized access and theft of personal data or confidential information provided by users and / or customers, Address: Av. This Privacy Policy is effective from the time that the Owner gives his consent.
